Celebrate #21Strong:
Our state senators had to stay late and skip trick-or-treating with their families, but thanks to a show of incredible unity and commitment, the Democrats held strong and ran out the clock on the GOP’s efforts to overturn Governor Cooper’s veto on the budget. The bad news is that means that we will enter 2020 with continued budget uncertainty, but it also means that the GOP wasn’t able to force through a bad budget. Your reps are probably going to be hungover tomorrow from a long session, but take a moment to call the Democrats’ offices or tweet them and thank them for their solidarity. If you have a GOP rep, call them and tell them to support a budget that actually gives teachers good raises and that provides funding to expand Medicaid.

Tell Governor Cooper to Veto SB 250:
[From the ACLU] SB 250 would require the State Board of Elections to identify and remove people from voting rolls who — at some point in the past — have been excused from jury service because they said they were not U.S. citizens. That information, however, is often unreliable and difficult to verify. For example, a person's information may not be updated after they become a naturalized citizen. Similar voter purge programs have resulted in eligible registered voters having their right to vote denied. Worse, because it makes these records publicly available, it could expose people to prosecution by ICE. I’m not going to recreate the wheel here. Go to the ACLU website and use their email tool to contact the Governor.

Other good news:
The NCGA finally passed the bill that closes the “Consent Loophole.” as many of you know, North Carolina had a horrible law on the books that did not allow people to revoke consent once the sexual act was initiated. It’s shameful that it took several years for the NCGOP to bring the bill to a vote, but the bill passed both chambers unanimously and now heads to Governor Coopers desk.

Pass a Federal Revenge Porn Law:
California Rep. Katie Hill resigned from Congress earlier this week, and a once-promising political career has been derailed, in large part because a malicious ex chose to publicly humiliate her by providing naked photos to a right-wing propaganda site. Hill didn’t deserve to be treated this way. We know that women, people of color, and members of the LGBTQ community are far more likely to be victimized by revenge porn. The most prominent revenge porn bill on Capitol Hill — the Stopping Harmful Image Exploitation and Limiting Distribution (SHIELD) Act — would establish federal criminal liability for individuals who share private, sexually explicit or nude images without the consent of those photographed. While 46 states have revenge porn laws, we need a federal law because jurisdiction is often fuzzy. Questions come up like where the film was uploaded, where it was taken, and so on, all of which make prosecution more complicated. This is a form of violence, and it needs to be stopped. Period. We need a federal law.

Oppose the Refugee Ban:
The Trump-GOP is once again attacking the rights of refugees and other migrants. The Trump Administration announced it would set a refugee cap of 18,000 people for the fiscal year, which is an incredibly small number, and the order would also allow states to ban resettlement. They have also not allowed a single refugee into the United States in the month of October. These changes to US refugee policy are “tantamount to destroying the program,” according to experts, as the amount of people displaced worldwide continues to grow. Let’s do what we can to stand up for the rights of refugees to seek asylum in our country.

Senate Budget Veto Override Vote:
The NCGA senate cancelled the vote again on whether or not to override Governor Cooper's budget veto. They didn’t have the votes on Monday, so they tried again on Tuesday, and they didn’t have the votes again, so they tried again on Wednesday, and here we go again. The #21Strong Democratic coalition has stood strong, so they deserve a ton of credit.Tell your senators to uphold the veto. We need a better budget. They are, once again, pushing corporate tax cuts at the expense of providing teachers with raises. They are continuing to reject Medicaid expansion, despite the fact that it would save taxpayers money. We still have a thin margin, though (like 1-2 votes), so we need everyone to hold strong so that the NCGOP will be forced to sit at a table and negotiate. If you can show up and make your presence felt, please do so. The GOP is less likely to try any shenanigans when they know a bunch of us are watching.

Call our Burr for his Inconsistency on Taxes:
Today, the NCAA finally recognized the humanity of their student athletes, opening up a pathway for them to profit from their labor. For decades, college athletes have been unable to endorse products or to get royalties from sales related to their name or image. Now players will be able to seek out endorsements. But Senator Burr (R-Extreme Privilege) doesn’t want those students, many of whom are poor or come from minority backgrounds to profit and has threatened to tax their tuition subsidies. For someone who claims to love tax cuts, this is a huge inconsistency. Some might even call it hypocrisy. Let’s call him out.

Block For-Profit Colleges from Receiving Federal Financial Aid:
A bill introduced this month by Rep. Pramila Jayapal, D-Wash., and Sen. Sherrod Brown, D-Ohio, dubbed the “Students Not Profits Act of 2019,” would ban the U.S. Department of Education from sending its federal grants and loans to for-profit colleges. The research about for-profit schools has shown that they serve their students poorly and often leave them deeply in debt. Many are not accredited. Their students go on to earn significantly less than public university students, despite the fact that for-profit colleges charge significantly more to attend. Half of student loan borrowers from for-profit schools prove unable to repay their loans, and tens of thousands of people have accused the colleges of fraud.

Add PFAS to the Clean Water Act:
[From Garrett Raczek] 1. Adding PFAS, as a class, to the Clean Water Act empowers the EPA to set discharge limits on PFAS into surface waters--like the Cape Fear and Haw rivers--which over 1.5 million residents rely on as their primary source for drinking water. This allows states, like NC, to regulate the presence of PFAS through discharge permits. Without this addition, states are left guessing where PFAS is being used and released.

2. Adding PFAS, as a class, to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) empowers the EPA to unlock Superfund law. This will allow states, like NC, to force the polluter to pay. Companies, like Chemours, should pay for the mess they made. This addition would allow that to happen. Without it we are left paying for someone else's mess.

3. Adding PFAS, as a class, to the Toxic Release Inventory will allow states, like NC, to monitor where PFAS are being used and released within the state. Currently, NC's DEQ is having to guess where PFAS chemicals are used.

End Gerrymandering in North Carolina:
The NCGOP is still blocking meaningful legislation to end gerrymandering and to create independent redistricting commissions. There are several bills that do this. HB827 - NC Citizens Redistricting Commission may be the easiest to pass because it only has to achieve a simple majority in each chamber (and be approved by the Governor). Gen X Contaminated Water Protest:
[From North Carolina Stop Gen X in Our Water] On Saturday, October 26th we will host a Global PFAS Protest at Chemours. We have our first Native American tribe joining us in the fight against PFAS. The Cape Fear Tuscarora Tribe will be our state’s tribal representatives in our fight for clean water. On Saturday we will have two other tribes United in our fight for clean water, the Occoneechee Saponi and Choctaw. We will be joined by both warriors and water protectors from all three tribes.

The protest will be Saturday, October 26th from 11:30 am-3:00 pm at the Chemours facility in Fayetteville.

Oppose the Confirmation of Steven Menashi to the U.S. Court of Appeals:
There still has not been a vote on the confirmation of Steven Menashi to the 2nd Circuit of the Court of Appeals. Steven Menashi would be an incredibly harmful nominee.  His views are too radical, and he has actively worked to limit immigration. He is an acolyte of Stephen Miller. In his current role as an Associate White House Counsel, he is a member of Stephen Miller’s Immigration Strategic Working Group. This working group is directly responsible for administering the Trump administration’s most draconian anti-immigrant measures.  Menashi has indicated that he worked on a broad range of immigration issues, including cutting the refugee admission cap to a historic low,  enacting the “remain in Mexico” policy, barring refugees who do not seek asylum in another country en route, declaring a state of emergency while also unlawfully diverting federal funds to build a wall along the southern border, and threatening to block immigrant children from their constitutional right to access public education. Additionally, Menashi has made deeply offensive comments about the Muslim community, making him incapable of serving as an impartial arbiter in many cases that would come before him if confirmed as a judge. Get Involved in Swing Left:
The primaries are still a few months away (although they are approaching VERY quickly), and many of us may not have decided on which candidates to support. BUT we all want to beat Trump and the GOP at every level. Swing Left can help us do that. Swing Left sees North Carolina as a “Super State.” We are a swing state for the Electoral College, our Senate race is competitive, we have competitive House races, and our state legislature will be redrawing districts in 2020. NC2 is looking especially competitive. Sleepy George Holding has received just ONE donation from a constituent in the last quarter. ONE. Let me say that again. George Holding only has one constituent who thinks his campaign is worth supporting financially. So, we have that going for us. Which is nice.

Just a reminder that the Shield Act will close loopholes that allow foreign spending in our elections, boost disclosure and transparency requirements, and create a duty to report illicit offers of campaign assistance from foreign nations or governments. Stop Making Teachers Pay for their own Subs:
When North Carolina teachers take a personal day, they are required to pay $50 for a substitute out of their own paychecks per day. Teachers in North Carolina are already severely underpaid, and while this may not seem like a huge amount, it can make a big difference when your budget is tight. It is also downright insulting. These kinds of petty policies are not good for teacher morale, and Governor Cooper is correct that this needs to stop.

Indivisible Triangle Daily Call to Action has been active since November 2016, just days after Trump was elected. Since then, we've used Facebook to post daily scripts and actions for people to use to contact their lawmakers at the state and federal levels. We've also hosted multiple town halls, helped organize the Raleigh March for Our Lives, and more.
